Robin FMS - Terms and Conditions

These Terms and Conditions govern access to and use of Robin FMS, a funeral management software platform. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Definitions

  • Service: The Robin FMS funeral management software platform and related services provided through it.

  • Robin FMS: The funeral management system provided under these Terms.

  • Operator: Robin FMS is operated by:

  • Customer: A funeral business, organisation, or individual that registers an account to use the Service.

  • User: An employee, contractor, or authorised individual who accesses the Service under a Customer account.

  • Client Portal User: A member of the public invited by a funeral director to access funeral information through the Robin FMS client portal.

  • Customer Data: Any information uploaded or stored within the Service by a Customer or its Users.

2. Description of Service

Robin FMS provides funeral management software including but not limited to:

  • funeral case management
  • document storage
  • invoicing
  • scheduling
  • cremation and burial tracking
  • client portals
  • donation links

Robin FMS is a software tool designed to assist funeral directors in managing their operations. Robin FMS does not provide legal, regulatory, or professional funeral advice. Customers remain responsible for ensuring compliance with all applicable laws and regulations.

3. Account Registration

Customers may create accounts to access the Service.

If you create an account on behalf of a business or organisation, you confirm that you have authority to bind that organisation to these Terms.

Customers may invite authorised Users such as employees or contractors.

Customers are responsible for maintaining login credentials, managing access permissions, and ensuring all Users comply with these Terms.

4. Client Portal Access

Customers may invite members of the public to access the Client Portal through a secure invitation link.

Client Portal Users access the system solely through invitation and act under the authority of the funeral director that invited them.

Robin FMS is not responsible for the information shared with Client Portal Users by funeral directors.

5. Eligibility

The Service may only be used by individuals aged 18 years or older.

6. Billing and Payment

Robin FMS operates on a pay-as-you-go billing model.

Charges apply per funeral managed through the system. Invoices are issued monthly and payment is due immediately upon invoice.

Failure to pay may result in suspension or termination of access. Fees paid are non-refundable except where required by law.

7. Free Usage

Robin FMS provides five (5) free funerals per account per calendar month. Charges apply for additional funerals according to pricing listed on the website.

8. Customer Data Ownership

Customers retain ownership of all Customer Data entered into the Service. Robin FMS does not claim ownership of Customer Data.

Customers may request a data export in CSV format.

9. Customer Responsibility for Data

Customers are responsible for the legality, accuracy, and lawful processing of all data uploaded. Robin FMS does not verify the legality or accuracy of Customer Data.

10. Data Retention and Deletion

Upon account termination Customer Data will remain available for 30 days, after which it may be permanently deleted.

11. Acceptable Use

Users must not:

  • violate any law or regulation
  • attempt unauthorised access
  • reverse engineer the software
  • resell or sublicense the platform
  • interfere with system infrastructure

12. Security and Permissions

Customers are responsible for managing account security, user access, and passwords. Robin FMS is not responsible for unauthorised access caused by poor security practices.

13. Confidentiality

Both parties agree to treat non-public information received through the Service as confidential.

14. Intellectual Property

All intellectual property rights in Robin FMS remain the property of CTL Services. Customers receive a limited, non-exclusive licence to use the Service for business purposes.

15. Third-Party Infrastructure

Robin FMS uses third-party providers including Amazon Web Services (AWS) to operate the platform. Robin FMS may subcontract services where necessary.

16. System Availability

Robin FMS is provided on an "as available" and "as is" basis with no guaranteed uptime.

17. Customer Responsibilities

Customers remain responsible for verifying funeral arrangements, documentation accuracy, and regulatory compliance.

18. Liability Limitation

CTL Services shall not be liable for indirect losses, loss of profits, business opportunities, or reputational damage.

Total liability shall not exceed the total fees paid by the Customer in the twelve months preceding the claim.

19. Indemnification

Customers agree to indemnify CTL Services against claims arising from Customer Data, misuse of the platform, or violation of law.

20. Account Suspension and Termination

Robin FMS may suspend or terminate accounts for non-payment, breach of Terms, unlawful activity, or system misuse.

21. Assignment

Customers may not transfer their rights under these Terms without written consent. CTL Services may assign the Terms as part of a business transfer or restructuring.

22. Service Modifications

Robin FMS may modify or discontinue features of the Service at any time.

23. Marketing and Branding

Robin FMS may reference Customers for marketing purposes including testimonials or case studies.

24. Privacy

Use of the Service is also governed by the Robin FMS Privacy Policy.

25. Force Majeure

CTL Services shall not be liable for failure to perform obligations due to events beyond reasonable control.

26. Waiver

Failure to enforce a provision does not waive the right to enforce it later.

27. Severability

If any provision is unenforceable, the remaining provisions remain valid.

28. Entire Agreement

These Terms constitute the entire agreement between the Customer and CTL Services.

29. No Partnership or Agency

Nothing in these Terms creates a partnership, employment relationship, or agency between the parties.

30. Governing Law

These Terms are governed by the laws of England and Wales. Disputes are subject to the jurisdiction of the courts of England and Wales.
